What are TIAs and How Will They Affect Your Organization?

In this video series, we break down one of the essential steps that is often required when transferring data from the EU: conducting Transfer Impact Assessments, also known as TIAs.  

This first video will explain what the TIA is and how it may affect your organization.

1. Gain a basic understanding of the TIA. 

A TIA is required when transferring data internationally out of the EU into a third country that has been considered inadequate. Most non-EU countries, including the U.S., have been deemed inadequate. 

For context, you’ll often see TIAs referenced in connection with Standard Contractual Clauses.  

The purpose of a TIA is to assess certain potential risk impacts to the data when it is being transferred outside of the EU.  

The TIA itself is a set of questions that are used to determine how risky certain data transfers might be to the protection of the data being transferred. The structure of a TIA is a Questionnaire + Evaluation (which is based on the Questionnaire Answers) + Results (which is based on the Evaluation). In other words, it’s a document that builds on itself to ultimately come to a conclusion about certain potential risks to data during international transfers. 

2. Consider how adding TIAs will affect your organization. 

The organizational impact of conducting TIAs will depend on your international data transfers. For this step, it is helpful to reference any data mapping that your organization has available. If your organization does not yet have any data maps, we would strongly recommend that your organization begin creating those, as data maps will make it much easier to visualize where data is being transferred, which informs when a TIA is necessary.
